How the Transfer Up Process Works

The process follows a clear, structured sequence from judgment to enforcement.

Step 1: Obtain a County Court Judgment

Before any enforcement action can take place, you must first have a County Court Judgment in your favour. This judgment confirms that the court has found the debtor liable for the amount owed. You can obtain a CCJ either by instructing a solicitor to issue proceedings on your behalf or by filing a claim yourself through the Money Claims Online service.

Step 2: Access the RCU Portal

Once you hold a CCJ for a minimum of £600 (this must be a non-regulated monetary judgment), you can log in to the RCU client Portal and submit your judgment for Transfer Up. The Portal guides you through the information required and allows you to track progress at every stage.

Step 3: Transfer Up to the High Court

RCU handles the administrative process of transferring your judgment from the County Court to the High Court. This involves preparing and filing the necessary paperwork with the court to convert your CCJ into a High Court judgment.

Step 4: Writ of Control Issued

Once the transfer is complete, the High Court issues a Writ of Control. This is the legal document that authorises an HCEO to attend the debtor’s premises and take enforcement action, including the seizure of goods if necessary.

Step 5: HCEO Instructed

With the Writ of Control in hand, RCU instructs a qualified HCEO to carry out enforcement. The officer will make contact with the debtor, attend their premises, and take whatever action is necessary and lawful to recover the debt on your behalf.

Key Requirements

Before submitting a judgment for Transfer Up, make sure the following conditions are met:

  • Minimum value: The judgment must be for at least £600, including any costs awarded by the court.
  • Judgment type: It must be a monetary judgment; you cannot transfer up non-monetary orders.
  • Non-regulated debt: The debt must not fall under the Consumer Credit Act. Regulated consumer debts cannot be enforced through High Court Enforcement.
  • Valid judgment: The CCJ must be current and not set aside or stayed by the court.

What If You Do Not Yet Have a Judgment?

If you are owed money but have not yet taken court action, you have two main options for obtaining a County Court Judgment.

Instruct a Solicitor

A solicitor can handle the entire process on your behalf, from issuing the claim to obtaining judgment. This is particularly useful for more complex cases or where the debtor is likely to defend the claim.

Issue Proceedings Yourself

For straightforward debts, you can issue a claim through the HMCTS Money Claims Online service at gov.uk/make-court-claim-for-money. You will need to register as a customer and send a formal Letter Before Action to the debtor before issuing proceedings.

Once you have your judgment, RCU can take it from there.
